ضمانات المحاكمة العادلة في المعايير الدولية Fair Trial Guarantees In International Standards

Résumé: تهدف هذه الدراسة إلى محاولة تسليط الضوء على ضمانات المحاكمة العادلة في المواثيق والاتفاقيات والمؤتمرات الدولية، وخلصت الدراسة إلى أن قواعد المحاكمة العادلة لها سند ومصدر خارجي تضمنه الإعلان العالمي لحقوق الإنسان وفصله العهد الدولي للحقوق المدنية والسياسية. حتى أضحت هذه القواعد علامة بارزة يصعب غض الطرف عنها، وكان أهمها: استقلال القضاء، وتقرير مبدأ المساواة أمام القضاء، وكفالة حق الدفاع، ووجاهية المحاكمة، وعلانيتها، وسرعة الفصل في الدعوى، وعدم جواز معاقبة المتهم عن الواقعة مرتين، وتقرير حق المتهم في الطعن في الحكم الصادر ضده. Abstract: This study aims to try to shed light on fair trial guarantees in international conventions, agreements and conferences, and the study concluded that fair trial rules have an external basis and source included in the Universal Declaration of Human Rights and separated by the International Covenant on Civil and Political Rights. Until these rules became a landmark that is difficult to ignore, the most important of which were: the independence of the judiciary, the establishment of the principle of equality before the judiciary, guaranteeing the right of defense, the presence and openness of the trial, the speed of adjudication of the case, the inadmissibility of punishing the accused for the incident twice, and determining the right of the accused to appeal. in his sentence.
