حقوق المهاجرين غير الشرعيين بين اعتبارات عالمية حقوق الإنسان والمقاربات الأمنية

Résumé: تتناول هذه الدراسة حماية حقوق المهاجرين من خلال اعتماد مقاربة حقوق الإنسان والتخفيف من شدة وطأة القبضة الأمنية في حل ظاهرة الهجرة غير الشرعية، فغالبا ما عومل المهاجرون على أساس تمييزي، مع ملاحظة انعدام اتفاقية دولية تعنى بحقوق المهاجرين بوجه عام عدا اتفاقية العمال المهاجرين، وهو ما يؤدي إلى تفعيل مواد اتفاقيات الأشخاص الأكثر ضعفا كاتفاقيات حقوق المرأة و الطفل وحقوق ذوي الاحتياجات الخاصة بإحداث مواءمة بين قوانين الهجرة و الاتفاقيات الدولية لحقوق الإنسان. ترتكز هذه الآليات في مجملها على المبادئ التالية: عالمية حقوق الإنسان وعدم قابليتها للتجزئة ومن بينها حقوق المهاجرين، تكامل الحقوق وعدم تجزئتها ، المساواة وعدم التمييز، إذ يقع على الدولة الالتزام التام بمحاربة التمييز ضد المهاجرين في القوانين والسياسات المقررة لظاهرة الهجرة ،و المساءلةمن خلال تمكين المهاجرين من وسائل الجبر والانتصاف في حال انتهاك حقوقهم أو الانتقاص وعدما اعتبار الهجرة جريمة بل مخالفة إدارية فقط Abstract: This study deals with the protection of the rights of migrants through the adoption of a human rights approach and the alleviation of the security grip in solving the phenomenon of illegal immigration. Migrants were often treated on a discriminatory basis, noting the absence of an international convention on the rights of migrants in general, The provisions of human rights conventions, as the case may be, to activate the articles of the conventions of the most vulnerable persons, such as the conventions on the rights of women and children and the rights of people with special needs, to harmonize immigration laws with international human rights standards. These mechanisms are based on: universal and indivisible human rights, including the rights of migrants, the enjoyment of human rights must be integrated, participatory and integrated, migrant's right to participate in the formulation of policies affecting their destiny, Equality and non-discrimination.
