المحكمة الدستورية: حامي للحقوق الأساسية والحريات العامة؟

Résumé: تعتبر الاختصاصات الدستورية للمحكمة الدستورية بمثابة صمام الأمان للازمات التي قد تمر بها البلاد، كما أنها تساعد الهيئات الدستورية المختلفة على تنفيذ مهامها بشكل أحسن وأكثر توافقا مع الدستور في نصه وروحه، ما يجعل المحكمة الدستورية الأقرب لحماية الحقوق الأساسية والحريات العامة. كما أن الدفع بعدم الدستورية يعتبر آلية فعالة في حماية الحقوق والحريات من كل انتهاك تشريعي، لهذا استوجب علينا دراسة دور المحكمة الدستورية في حماية الحقوق الأساسية والحريات العامة على ضوء دستور الجزائر المعدل سنة 2020؛ ورأينا أنها فعلا تعتبر ضامنا للحقوق والحريات وأن لها مستقبلا واعدا في هذا المجال. The constitutional functions of the Constitutional Court are considered as a safety to resolve crisis that a country may experience. It also helps the various constitutional bodies to perform their functions more efficiently and in a way that is more in line with the Constitution In its text and spirit. That make the constitutional court the nearest institution to protect the fundamental rights and public freedoms. The priority question of constitutionality is an effective mechanism in protecting rights and freedoms from every legislative violation. That is why we had to study the role of the Constitutional Court in protecting fundamental rights and public freedoms in the light of Algeria’s amended constitution in 2020; And we saw that it is actually a guarantor of rights and freedoms, and that it has a promising future in this field.
