عقبات التعاون الدولي في مجال استرداد عائدات جرائم الفساد و سبل تجاوزها

Résumé: الملخص : يكشف المقال عن طبيعة العقبات التي تعترض التعاون الدولي في مجال إسترداد الأموال المنهوبة المتحصل عليها من جرائم الفساد و تقوض جهود مكافحة هذه الظاهرة سواء العقبات السياسية منها أو التشريعية أو القضائية أو غيرها من العوائق و العقبات، تهدف هذه الدراسة إلى البحث عن آفاق تذليل هذه العقبات بغرض توثيق التعاون الدولي و تحقيق النجاعة في مجال إسترداد عائدات جرائم الفساد. يخلص هذا البحث إلى وجوب قيام إرادة سياسية حقيقية لدى الدول لمنع تبييض الأموال المتحصل عليها من جرائم الفساد و إخفاء مصدرها غير المشروع أيا كان مرتكبها و بصرف النظر عن الإقليم الذي إرتكبت فيه و هذا من خلال تبسيط الإجراءات و تسريع التعاون و إضفاء المرونة على مبدأ السرية المصرفية وتسهيل إجراءات رد الأموال المتأتية عن جرائم الفساد للجهة التي نهبت منها. Abstract: The article reveals the nature of the obstacles that hinder international cooperation in the field of recovery of stolen funds obtained from corruption crimes that undermine efforts to combat this phenomenon, whether political, legislative, judicial or other obstacles , this study aims to look for prospects for overcoming these obstacles in order to strengthen international cooperation and achieve efficiency in the field of recovery of the proceeds of corruption crimes. This research concludes that there must be a genuine political will on the part of States to prevent the laundering of funds obtained from corruption crimes and to conceal their illicit origin, regardless of the territory in which they were committed, by simplifying procedures, speeding up cooperation, giving flexibility to the principle of bank secrecy and facilitating procedures for returning funds derived from corruption crimes to the party from which they were looted.
