استرداد العائدات الإجرامية

Résumé: تعمل الدول و الحكومات على الصعيد الدولي أو الداخلي من أجل محاربة الفساد بكل أنواعه وعلى جميع الأصعدة ،وهذا عن طريق الحماية الوقائية التي تفرضها الإتفاقية الدولية لمكافحة الفساد أو عن طريق الأنظمة التشريعية الداخلية العقابية منها أو الإدارية ،ورغم هذه الجهود فإن جرائم الفساد في إنتشار وتزايد مستمر خصوصا مع الصعوبات الإقتصادية المفروضة بفعل العديد من العوامل . تبقى الخطورة الإجرامية تكمن في تهريب الأموال إلى الخارج و الصعوبة في إسترجاعها من طرف الدول التي تسعى إلى محاربة ظاهرة الفساد و إسترجاع العائدات الإجرامية من الدول التي تم إخفاء الأموال فيها ببنوك في حسابات مصرفية أو عن طريق إستثمارات تجارية في مشاريع متعددة ومتنوعة ،لذلك كان الهدف من هذه الدراسة هو معرفة السبل القانونية المتاحة من أجل إسترداد هذه الأموال عن طريق إتفاقية مكافحة الفساد لسنة 2003 وكذا القانون 06/01 المتعلق بالوقاية من الفساد ومكافحته. States and governments are working nationally and internationally to combat corruption of all types and at all levels. Their endeavor is driven by the preventive measures set forth by the International Convention against Corruption as well as the punitive or administrative domestic legislative systems. Despite these efforts, corruption crimes are on the rise, especially with the economic difficulties imposed by many factors. Among all corruption types, the criminal risk of funds smuggling overseas is very high. Furthermore, it is aggravated by the difficulty to recover the funds by countries seeking to combat corruption. Retrieving criminal proceeds from countries where monies have been hidden in bank accounts or through investments in various and varied projects. The aim of the study is, thus, to examine the legal avenues available for the recovery of these funds through the 2003 Anti-Corruption Convention as well as Law 06/01 on the prevention and control of corruption.
