قواعد دفع الضرر الفقهية وتطبيقاتها الطبية، مع تطبيقات خاصة بجائحة كورونا .

Résumé: للقواعد الفقهية أهمية كبيرة في ضبط الأحكام وبيان المناط الجامع لها؛ حيث يدخل تحت كل قاعدة ما لا ينحصر من مسائل الفقه في كل مجالات الحياة ؛ ومما يزيد القواعد الفقهية أهمية استيعابها للمستجدات والنوازل الطبية التي تنوعت مسالكها وتعددت أحكامها خاصة ما عمت به البلوى في زماننا من جائحة كورونا؛ وفي بحثي هذا تناولت بالشرح، والاستدلال، والتخريج لمسائل طبية ومسائل أخرى متعلقة بجائحة كورونا على مجموعة من القواعد الفقهية المتعلقة بدفع الضرر، و هي قاعدة: "الضرر يزال " و" الضرر يُدفَع بقدر الإمكان"، و" الضرر لا يزال بمثله “،" الضرر الأشد يزال بالضرر الأخف “، و "درء المفاسد أولى من جلب المصالح " و"المفاسد كل ما يلحق الضرر"۔ Abstract Jurisprudence rules have significant importance in deciding and theorizing the Islamic provisions. As It deals with countless number of jurisprudence’s issues in all aspect of life. And, What increases the importance of jurisprudence rules is their understanding and inclusion of the updates of contemporary issues including medical crisis especially in our time of the Corona pandemic which led to the emergence of new and multiple provisions; In this research, I dealt with the explanation, inference, and derivation of provisions regarding medical issues and other issues related to the Corona pandemic , based on a set of jurisprudential rules related to the prevention of harm, which is the rule: “removing the harm” and “the harm is avoided as much as possible,” and “the harm can’t be removed by another harm,” “the most severe harm can be removed by the lesser harm”, and “preventing harm is more important than bringing benefits” and corruption is everything that causes harm.
