تطبيقات فقهية معاصرة لقاعدة ( تصرف الإمام على الرعية منوط بالمصلحة ) في ظل تفشي جائحة كوفيد -19 في مجال الصلاة

Résumé: يمر العالم في هذه الفترة بجائحة وباء فيروس كورونا المستجد ( كوفيد 19) الخطير والسريع الانتشار الذي أفضى إلى أدى إلى نتائج سلبية عديدة من أبرزها كثرة عدد الوفيات مما أكد على قيام الحكومات بالاطلاع بمسؤولياتهم المتنوعة،ومن أهمها المحافظة على حياة الناس التي هي من الضرورات الخمس،لذا أصدرت قرارات وتدابير احترازية وقائية للحد من انتشار هذا الوباء الفتاك تحت مظلة يسر الإسلام ومرونته واستنادًا إلى القاعدة الفقهية (تصرف الإمام على الرعية منوط بالمصلحة) لجلب النفع ودفع الضرر. لذا تناول البحث مفهوم القاعدة وتأصيلها وأهميتها وأدلة مشروعيتها، وتضمن التطبيقات الفقهية المعاصرة لبعض المسائل التي واكبت مرض كوفيد 19 كتعليق الصلاة في المساجد، ووجود التباعد الجسدي بين المصلين، وصلاتي العيدين والجمعة وصلاة الجنازة .ومن أهم النتائج التي خلص إليها البحث: جواز تعليق الصلاة في المساجد وجواز التباعد بين المصلين في صلاة الجماعة . The world is seeing a period of the emerging Corona pandemic (COVID-19) that is dangerous and spreading rapidly and led to a large number of global deaths. This pandemic has put a large responsibility on governments to preserve the lives of their citizens under the basic premises of Sharia, which are self, mind, religion, money and offspring. I published the findings and precautionary measures to limit the spread of this deadly pandemic under Islam’s values and based on the jurisprudence (to benefit the parish) to bring benefit and defend against harm. The research discusses the concept, its origin, its importance and its legitimacy guidelines. It discusses contemporary Islamic doctrine and application of some the issues related to COVID-19, such as the suspension of prayer in mosques, social distancing among worshippers during congregational prayers, and Friday prayers, Eid prayers and funerals. The most important findings in this research: It is permissible to suspend prayers in mosques and the distance between worshipers during congregational prayers.
