أثر الوساطة الجزائية على الجرائم الأسرية في التشريع الجزائري

Résumé: من أجل مواجهة الفشل النسبي للإجراءات الجنائية الكلاسيكية في معالجة الظاهرة الإجرامية وخاصة تلك الجرائم كثيرة العدد قليلة الخطورة التي يرتكبها البالغون والأحداث، سعت المبادئ التوجيهية الدولية للتحول من السياسة الجنائية المعاصرة إلى تمهيد الطريق للأخذ ببدائل الدعوى العمومية وصولا إلى تكريس نظام الوساطة الجزائية، والتي تعتبر وسيلة لحل المنازعات ذات الطبيعة الجنائية بطرق غير تقليدية، والتي تسعى إلى تجسيد أنسنة العدالة الجنائية نظرا لخصوصيات الأطراف الخصومة الأسرية وهذا ما أخد به المشرع الجزائري في مضامين قانون الإجراءات الجزائية بموجب رقم 15-02 المؤرخ في 23 جويلية 2015، وكذا قانون الطفل 15/12 المؤرخ في 15 جويلية 2015 .
