مبدأ العذر الطارئ وأثره في فسخ عقد الإيجار دراسة مقارنة بين الفقه الإسلامي والقانون المدني الجزائري
Résumé: إن مبدأ العذر الطارئ من أهم المبادئ المقررة لتحقيق التوازن بين مصلحة المتعاقدين، فهو يضمن استقرار المعاملات بين الناس ويكفل حقوقهم، ويتجلى أثره في عقد الإيجار في كونه مسوّغا للخروج عن بنود هذا العقد إلى المطالبة بفسخه بإرادة منفردة. Abstract: The principle of emergency excuse is one of the most important principles established to achieve a balance between the interests of contractors. It guarantees the stability of transactions between people and guarantees their rights. The effect of the lease agreement is evidenced by the fact that in case of lack of respect of the provisions of this agreement, it gives the possibility to terminate the agreement unilaterally.
