أثر الظروف الطارئة على التزامات عقد الإيجار في الفقه الإسلامي والقانون المدني الجزائري
Résumé: يهدف البحث إلى إبراز موقف الفقه والقانون المدني الجزائري من وضع عقد الإيجار في الظروف الاستثنائية الطارئة، وبيان الأعذار المبيحة لفسخ العقد، أو تخفيف بعض مستلزماته مقارنين في ذلك بين الفقه الإسلامي والقانون المدني الجزائري، ومبرزين علاقة عقد الإجارة في الظروف الطارئة بنظرية القوة القاهرة بالقانون ومبدإ وضع الجوائح في الفقه الإسلامي. This research seeks to show the stance of the jurisprudence and the civil law from putting tenancy agreement in exceptional emergency conditions and demonstrating the permissible excuses for the annulment of the contract or alleviating some of its necessities. In it, we compare between Islamic jurisprudence and the Algerian civil law by accentuating the relationship between tenancy contract in emergency situations to the concept of "The Majeure Force" and the concept of "pandemics" in the Islamic jurisprudence.
