التلوث البيئي وأثاره على حق الإنسان في بيئة نظيفة

Résumé: يعتبر التلوث أكبر تهديد للبيئة الإنسانية، ذالك لما يخلفه من أثار خطيرة عليها لايمكن إصلاحها تظهر أثارها مستقبلا، واعتبار الإنسان السبب الرئيسي في انتشار التلوث، وهذا مايؤدي إلى إسقاط حقه في بيئة نظيفة ورغم الجدل الواسع الذي صاحب هذا الحق بين مؤيد ومعارض إلا أن تكريس هذا الحق في معظم الدساتير الوطنية فك اللبس عن هذا الحق ووضعه مع الحقوق الإنسانية الأخرى، ولحماية هذا الحق وضع مجموعة من الآليات القانونية لتخفيف من هذه الأثار الناتجة عن الأنشطة البشرية. وهذا ما جاء به القانون 03-10 المتعلق بحماية البيئة في إطار التنمية المستدامة من خلال طرحه لمجموعة من المبادئ الوقائية لحماية البيئة. الكلمات المفتاحية: البيئة – التلوث – التنمية المستدامة – الحق في بيئة نظيفة. Abstract : Pollution is considered one of the greatest threat to the human environment, thus due to the serious effects that cannot be repaired, the effects of which will appear in the future. Humans are considered the main cause of the spread of pollution, this leads to the abrogation of their right to a clean environment. Despite the widespread controversy that accompanied this right between supporters and opponents, consecrating this right in most national constitutions is to disambiguate it and place it with other human rights. To protect this right, a set of legal mechanisms have been put in place to mitigate these effects resulting from human activities. Therefore,the law 03-10 relating to environmental protection within the framework of sustainable development stated by proposing a set of preventive principles for protecting the environment.
