شرعية استخدام القوة لفرض الديمقراطية في القانون الدولي

Résumé: إن التدخل لصالح ديمقراطية النظام يُعد من أهم المواضيع التي دار حولها النقاش بين الفقهاء من ناحية شرعيتها وفقا لقواعد القانون الدولي. فهناك من يرى أن استخدام القوة و التدخل العسكري بهدف إعادة الديمقراطية كشكل من أشكال أنظمة الحكم و الحفاظ عليه يُعد أمرا غير مشروع، يتنافى مع حق الشعوب في تقرير المصير و اختيار نظام الحكم الذي يناسبها، و هناك الرأي المقابل المؤيد للتدخل الدولي بسبب طبيعة نظام الحكم في الدولة، لعدم تعارضه مع مقاصد الأمم المتحدة، على اعتبار أنه من حق هذه المنظمة أن تفحص النُّظم الداخلية في الدول و أن تتدخل بصورة أو بأخرى إذا تبيَّن أن النظام فيها غير ديمقراطي. The Intervention in favor of the democracy of the regime is one of the most important topics in which jurists debated in terms of their legitimacy in accordance with the rules of international law. There are those who believe that the use of force and military intervention aimed at restoring democracy as a form of government and maintaining it is illegal, contrary to the right of peoples to self-determination and the choice of a system of government that suits them, there is the opposing view of international intervention because of the nature of the system of government in the state, because it is not incompatible with the purposes of the United Nations, since it is entitled to examine the internal systems of States and intervene in one way or another if it turns out that the system is undemocratic.
