Résumé: تمثل الممتلكات الثقافية إرث الحضارات القديمة وفخر الإنسانية، ونتيجة ذلك حظيت بالاهتمام من قبل واضعي القانون الدولي الإنساني والذين حاولوا وضع قواعد تحمي هذه الممتلكات زمن النزاعات المسلحة. وقد تجلى ذلك من خلال اتفاقية لاهاي 1954 وبروتوكولها الأول، ولكن نتيجة القصور الذي اعتراها وكثرة الانتهاكات التي تعرضت لها قواعد الحماية هذه، تم التفكير في ضرورة وضع نصوص جديدة تعزز هذه الحماية، وبذلك تم اعتماد البروتوكول الثاني لعام 1999، والذي جاء بنصوص تثمن الحماية المقررة للممتلكات الثقافية زمن النزاعات المسلحة.
