إمكانيّة تحديث الفكر الدّينيّ في الفضاء الإسلاميّ: "حصّة المرأة في الميراث نموذجاً" The Possibility Of Modernizing Religious Thought In The Islamic Space: "women's Share In Inheritance As A Model

Résumé: يهدف هذا البحث إلى المساهمة في إثراء موضوع الملتقى الدّوليّ-المنظّم بمناسبة اليوم العالميّ للفلسفة–الموسوم بـ: أسئلة تحديث الفكر الدّينيّ في الفضاء الإسلاميّ" في محوره الخامس، والمعنون بـ: تجارب تجديد العلوم الدّينيّة، وذلك بعرض إمكانيّة تحديث النّظر في حصّة المرأة من الميراث في الفقه الإسلاميّ باعتبارها تفكيراً في الدّين يحتمل النّسبيّة، وليست الدّين نفسه الذي يلزم القطعيّة والثّبات. وبعد التّعرّض لأدوات وآليات التّفكير وإنتاج المعرفة، المتمثّلة في مصادر التّشريع التي استنبطت منها أحكام الميراث، وتمحيص سند هذه النّصوص، وتفقّد قوّة دلالتها، والنّظر إليها مجتمعة، تبيّن أنّ الأنثى ترث نصف الذّكر عند توريث الأبناء مع البنات والإخوة مع الأخوات فقط، أمّا الحالات الأخرى وهي الأكثر فقد تأخذ الأنثى مثل الذّكر، أو أكثر منه، أو تحجبه، وأنّ الآيات المستدلّ بها قطعيّة الثّبوت والدّلالة، وأنّ المشكلة تكمن في عدم التّفريق بين العدل والمساواة. كلمات مفتاحية: المرأة؛ الرّجل؛ الميراث؛ العدل؛ المساواة. Abstract: This research aims to contribute to enriching the theme of the international forum – organized on the occasion of the World Philosophy Day - tagged with: Questions of Modernization of Religious Thought in the Islamic Space" in the fifth axis entitled: "Experiences of Renewal of Religious Sciences" by presenting the possibility of modernizing the consideration of women's share of inheritance in Islamic jurisprudence as a After exposure to the tools and mechanisms of thinking and knowledge production, represented in the sources of legislation from which the provisions of inheritance were derived, and scrutinizing the support of these texts, and losing the strength of their significance, and looking at them together, it was found that the female inherits half of the male when inheriting sons with daughters and brothers with sisters only, while the other cases - which are the most - may take the female like the male, or more than him, or withhold it, and that the verses inferred are definitive and significant, and that the problem lies in the lack of distinction between justice and equality.
