النظام القانوني للدفتر العقاري في التشريع الجزائري

Résumé: القانوني للدفتر العقاري في التشريع الجزائري هذا الملخص يضم أهم المميزات و الخصائص و أيضا الطبيعة القانونية التي تحكم الدفتر العقاري و بما أن هذا الأخير يثبت الملكية و يعتبر سند رسمي ذو حجية مطلقة في الإثبات ، فقد تناولت دراستنا أهم المواقف بدية من موفق المشرع الجزائري إلى موقف القضاء من هاته الوثيقة بإعتبار أغلب المنازعات القائمة في المحاكم تنشب حول موضوع الملكية العقارية كان لزاما علينا أن نتطرق إلى طبيعة المنازعات العقارية و الجهات القضائية المختصة بالفصل فيها ، و في الأخير نستخلص أن الدفتر العقاري يبقى السند الوحيد لإثبات الملكية العقارية في المناطق الممسوحة و قد ساهم في فض جل النزاعات المتعلقة بالملكية العقارية . الكلمات المفتاحية الدفتر العقاري/الملكية/القضاء/التشريع . Summary of the note The legal system of the real estate book in Algerian legislation This summary includes the most important features and characteristics, as well as the legal nature that governs the real estate book, and since the latter proves ownership and is considered an official document with absolute authenticity in proof, our study dealt with the most important positions starting from the position The Algerian legislator referred to the position of the judiciary on this document, given that most of the existing disputes in the courts arise on the issue of real estate ownership.
