تحقيق القول في مسألة تعارض قاعدة سد الذرائع مع خبر الواحد عند الإمام مالك

Résumé: جاء هذا البحث للوقوف على مدى صحّة ما اشتهر على ألسنة بعض الباحثين أن من أصول الإمام مالك تقديم قاعدة سد الذرائع على خبر الواحد في حالة التعارض, وهذا من خلال دراسة تطبيقية لبعض الأحاديث التي تكشف لنا حقيقة مذهب الإمام مالك في هذه المسألة. وقد توصلنا من خلال هذا البحث إلى أن هذه المسألة لم ينقل فيها عن الإمام مالك ما يثبت ذلك, وإنما هي من اجتهاد بعض المحققين المعاصرين من خلال جمعهم لمسائل رأوا أن مالكا ترك العمل فيها بخبر الوحد لتعارضه مع أصل سدّ الذرائع . This research came to stand on the correctness of what was known on the year some researchers, Imam Malik assets provide pretexts to the news, the base in the event of a conflict, and this through the study of the practical application of some Hadiths which reveals to us the truth of the doctrine of the Imam Malik in this matter. and we have come through this research that this issue did not convey the Imam Malik proves it, but the DILIGENCE of some contemporary investigators through the compilation of the issues they saw that the owner of the Labor left a piece of group of its incompatibility with the origin of the pretexts.
