Résumé: يعد التعبير عن الإرادة العنصر الجوهري لإبرام العقد ، بحيث يتم بموجبه تبادل الإيجاب والقبول وتطابقهما، ومنه انعقاده، إلا أنّه في عقود التجارة الالكترونية يكتسي طابعا خاصا، بحيث تتبادل الإرادتان وتتناقل بوسائل الكترونية في غياب العناصر المادية التقليدية والبعد الجغرافي . Expressing willingness si an essential element to issue a contract with which we give accord and acceptation and their conformity, consequently, its accomplishment. While eclectonic trade contracts have a specified aspect considering that the two willingesses circulate by electronic means, and this in the absence of traditional material elements and the geographic distance.
