إشكالية عيوب الإرادة وآثارها على عقد الاستهلاك الالكتروني وفقا للقانون 05/18 المتعلق بالتجارة الالكترونية

Résumé: لقد نظم المشرع الجزائري المعاملات التجارية الالكترونية بموجب القانون رقم 18/05 المتعلق بالتجارة الالكترونية، وهي معاملات تبرم عن طريق وسائل الاتصال الالكتروني والتي تتم في أغلب الأحيان في صورة عقد استهلاك الكتروني، هذا الأخير الذي أثار الكثير من الإشكالات نظرا للطبيعة الخاصة التي يتميز بها، ومن تلك الإشكالات ما جاءت به هذه الدراسة والموسومة ب:"إشكالية عيوب الإرادة وآثارها على عقد الاستهلاك الالكتروني وفقا للقانون18/05 المتعلق بالتجارة الالكترونية"، فالمشرع الجزائري بإصداره لهذا القانون لم يعالج كل ما يتعلق ويخص عيوب الإرادة في إطار عقود الاستهلاك الالكترونية تاركا ما لم ينظمه للقواعد العامة، لذلك جاءت هذه الدراسة لبيان مدى تناول المشرع الجزائري من خلال قانون التجارة الالكترونية لعيوب الإرادة في عقد الاستهلاك الالكتروني، ومآل هذا العقد بعد أن يتأثر بعيب من عيوب الإرادة، لتتمحور إشكالية البحت أساسا حول آثار عيوب الإرادة على عقد الاستهلاك الالكتروني في ظل القانون 18/05 المتعلق بالتجارة الالكترونية. the Algerian legislator organized electronic commercial transactions under law no 18/05 on electronic commerce, these transactions are concluded through electronic communications and are often carried out in the form of an electronic consumption contract, The latter created many problems due to its special nature, including the problems mentioned in this study, which is known as “Problem of shortcomings of will and their on the electronic consumption contract in accordance with law 18/05 on electronic commerce” the Algerian legislator defended the issuance of the law which did not address all issues related to, and particularly, shortcomings in the framework of electronic consumer contracts, leaving the problems that were not regulated by the general rules, this study was made to show the extent to which the Algerian legislator, through the electronic commerce law, addressed the flaws in the electronic consumption contract, and the outcome of this contract after it was affected by a lack of will.
