مظاهر التعبير عن الإرادة في العقود عبر وسائل الاتصال الحديثة manifestations Of Expression Of Will In Contracts Through Modern Means Of Communication

Résumé: الملخص: مع تطور وسائل الاتصال الحديثة، و ظهور وسائل جديدة لإظهار المتعاقد رضاه في الفضاء الافتراضي برزت الحاجة إلى وجود قواعد جديدة تحكم التعبير عن الإرادة و تلاؤم الوسائط الالكترونية و يعبّر عن الإيجاب والقبول عبر شبكة المواقع بالكتابة الالكترونية و ذلك باستخدام لوحة المفاتيح أو النقر على أيقونة الموافقة، و يكون الإيجاب و القبول عن طريق البريد الالكتروني باستخدام لوحة المفاتيح و كذلك بالنقر على أيقونة الإرسال و هي لا تخرج في عمومها عن أحكام التعبير عن الإرادة باللفظ عند الفقهاء. و لا يختلف الإيجاب و القبول في العقد الالكتروني عن الإيجاب و القبول في العقد التقليدي إلا من حيث الوسيلة المستخدمة في التعبير عنهما، إذ يتم الإيجاب و القبول في العقد الالكتروني من خلال وسيلة إلكترونية سواء بطريقة لفظية، أو كتابة إلكترونية، أو دلالة فعلية من خلال شبكة الانترنت عبر الدخول إلى شبكة المواقع المعنية، أو البريد الالكتروني أو غرف المحادثة و المشاهدة للتعبير عن الإرادة. ABSTRACT: With the development of modern means of communication, and the emergence of new means to show the contractor his satisfaction in the virtual space, the need for new rules governing the expression of will and the compatibility of electronic media has emerged, and the offer and acceptance are expressed through the network of websites in electronic writing, by using the keyboard or clicking on the approval icon. And the offer and acceptance is by e-mail using the keyboard, as well as by clicking on the send icon, and it does not depart in general from the provisions of expressing the will verbally according to the jurists. The offer and acceptance in the electronic contract does not differ from the offer and acceptance in the traditional contract except in terms of the means used to express them. The Internet by entering the relevant network of sites, e-mail or chat rooms and viewing to express the will.
