تسوية البنايات في ظل المرسوم التنفيذيرقم 55/22

Résumé: في إطار ترقية النظام العام العمراني، و ترقية المدن الجزائرية من التشوه في البيئة العمرانية، عمد المشرع الجزائري لوضع ترسانة قانونية من أجل الحفاظ على هذا النظام، إلى أنه ونظرا إلى انتشار بنايات فوضوية، بادر المشرع مرة أخرى بوضع آلية تسوية وضعية البنايات من خلال قانون تسوية البنايات رقم 08-15 و لكن هذا الأخير لم يحقق النتائج التي وضع لأجلها، فبادر مرة أخرى بمرسوم آخر هو المرسوم التنفيذي رقم 22-55 جاء من آجل الوضع الكارثي الذي أل اليه العمراني في الجزائر. فقد جاء هذا المرسوم بجملة من الشروط و الإجراءات الاكثر تبسيطا لتسوية البنايات، من اجل تسليم رخصة البناء المعدلة أو شهادة المطابقة على سبيل التسوية مع فرض هذا الأخير لبعض الغرامات من أجل تحقيق الردع العام و الخاص. الكلمات المفتاحية تسوية البنايات، النظام العام العمراني، رخصة البناء المعدلة، شهادة المطابقة على سبيل التسوية. Abstracts The algerian legislature set out a legal arsenal to preserve this system within the framework of boosting the urban public policies and algerian cities from the constrctionchaos . However many reasons led to the emergence of an urban imbalance .the legislature tried to contain the spread of chaotic constructions via decree 15-08 to end the disastrous situation that urbanization in algeria had led to .however he still needs to achieve the desired results. the decree came with new conditions and procedures for settling buildings to hand over the amended building permit or certificate of conformity of comformity as a matter of settlement with the latter impoing some fines to achieve punlic deterrence . keywords leveling the buildings / the general urban system /the amended buildings permit / the certifcate of conformity as a matter of settlement
