المستحـدث في تسـوية البناءات غيـر الشـرعية بموجب المـرسـوم التنفيذي 22-55

Résumé: تعتبر عقود التعمير أدوات رقابية قبلية وبعدية، تنصب على المجال العمراني لارتباطها المباشر به، تسمح للمشرع في ضبط النشاط العمراني لضمان تكريس السياسة العمرانية العامة للدولة، إلا أنها شكلت في الواقع مخالفات نجم عنها بنايات غير مشروعة شهدتها مختلف المدن. وبهدف معالجة وضعية البناء اللاشرعي ومحاربة ظاهرة التشوه العمراني، ظهر القانون 08-15 المتعلق بتسوية وضعية مطابقة البنايات، الذي عرف محدودية في الأداء، وبالتالي أدى إلى تدخل الدولة من جديد عن طريق التشريع بوضع تدابير تحد من تفاقم هذه الظاهرة متمثلة في المرسوم التنفيذي 22-55 المتعلق بتسوية البنايات غير المطابقة لأحكام رخصة البناء المسلمة، والذي جاء بمنظور جزائي مقابل تسوية بهدف تسوية وضعية البناء اللاشرعية واستقطاب أكبر عدد من المخالفين لأحكام الرخصة، ومحاربة ظاهرة البناءات اللاشرعية من خلال منح رخص بناء تعديلية و شهادة المطابقة على سبيل التسوية لإضفاء طابع شرعي البناية.
