فاعلية التحقيق العقاري في اثبات الملكية العقارية الخاصة

Résumé: استحدث المشرع الجزائري بموجب القانون رقم 07-02 المتضمن تأسيس لجراء المعاينة حق الملكية العقارية وتسليم سندات الملكية عن طريق تحقيق عقاري، اجراء هام يهدف من وراءه إلى تطهير الملكية العقارية الخاصة من خلال تمكين الأشخاص من عقود ملكية عن طريق أدوات واجراءات قانونية بسيطة جاء بها المشرع من خلال الأمر السالف الذكر ليحتوي على حلول موازية لفشل آلية عقد الشهرة بتغطية النقائص و الآثار السلبية التي خلفها العمل بهذا الأخير؛ الأمر الذي دفع بتعجيل استراتيجية التحقيق العقاري لتدارك السلبيات والوصول إلى حلول لمشاكل إثبات الملكية العقارية الخاصة. By Act No. 07-02 establishing the right to real property and the delivery of title through a real estate investigation, the Algerian legislature introduced the right to property ownership and the delivery of title deeds through a real estate investigation. an important measure aimed at cleansing private property by enabling persons to enter into property contracts through simple legal instruments and procedures introduced by the legislator through the above-mentioned ordinance to contain parallel solutions to the failure of the famous contract mechanism to cover the shortcomings and negative effects of the latter's operation; This prompted the acceleration of the real estate investigation strategy to remedy the shortcomings and to find solutions to the problems of establishing private real estate ownership.
