Legal Adaptation Of Consensual Justice

Résumé: ٍ Abstract: For a long time, criminal justice has relied on the public lawsuit as a means of enforcing the state’s right to punish, as it is a lawsuit administered by the Public Prosecution through a judicial trial in which it acts as the prosecutor against the defendant, who asserts his right to freedom and frequently denies the allegations, ultimately seeking to impose a penalty on the defendant, typically resulting in a loss of liberty. Although consensual justice in its various forms represents practical solutions to the problems of criminal justice in general, it reflects the philosophy of this case and the harm it has caused. This research paper seeks to illuminate the legal adaptation of consensual justice by exploring the legal nature of this system and assessing its legitimacy in both crimes against individuals and those impacting the public interest Keywords, publique action- publique prosecution -consensual justice- legal adaptation- legality- crimes. ملخص لقد ظلت العدالة الجنائية لفترة طويلة من الزمن تعتمد على الدعوى العمومية كوسيلة لاقتضاء حق الدولة في العقاب، وهي دعوى تديرها النيابة العامة من خلال محاكمة قضائية تضطلع فيها بدور الادعاء في مواجهة المتهم الذي يتشبث بحقه في الحرية وينكر في الغالب التهمة المسندة إليه، وتهدف في نهاية المطاف إلى توقيع عقوبة على المتهم تأخذ غالبا صورة العقوبة السالبة للحرية. ولئن كانت العدالة الرضائية في مختلف صورها تمثل حلولا عملية لمشكلات العدالة الجنائية عموما، فهي قبل ذلك تعكس الفلسفة من هذه الدعوى وما لحقها من ضرر. وتهدف هذه الورقة البحثية الى تسليط الضوء على التكييف القانوني لموضوع العدالة الرضائية، من خلال معرفة الطبيعة القانونية لهذا النظام ومدى مشروعيته في الجرائم الواقعة على الافراد والجرائم الماسة بالمصلحة العامة. الكلمات المفتاحية: الدعوى العمومية- النيابة العامة- العدالة الرضائية- التكييف القانوني- المشروعية-الجرائم.
