المحكمة الدستورية في الجزائر بين الاستقلالية والتّكامل

Résumé: إن دراسة موضوع استقلالية المحكمة الدستورية يرمي إلى البحث في طبيعتها القانونية، والتعرض إلى مدى استقلاليتها عضويا ووظيفيا، وذلك في ضوء التعديل الدستوري لسنة 2020، والنظام الداخلي للمحكمة الدستورية، والقانون رقم 22-19 المحدد لإجراءات وكيفيات الإخطار والإحالة المتبعة أمام المحكمة الدستورية. استحدث المؤسس الدستوري في ظل نظام المحكمة الدستورية شروط جديدة لتولي العضوية بالمحكمة الدستورية تكرس استقلالية وحياد أعضائها من حيث اشتراطه الكفاءة، وحرصه على اقرار الحصانة للأعضاء، مع استبعاد البرلمان من التمثيل في التشكيلة ليبقى هذا الأخير في إطار مهمته الأصيلة –التشريع والرقابة- ما نثمنه بشّده لإبعاد المحكمة عن أي توجهات حزبية وسياسية، أما عن استقلاليتها الوظيفية فبالرغم من إلزام جميع السلطات العمومية والسلطات الإدارية والقضائية بالتنفيذ الفوري لقراراتها ما يؤسس لحصانتها وظيفيا، إلا أن اعفاء هذه الأخيرة من التحرك التلقائي يجعل منها حبيسة الاخطار والاحالة. Examination of the Constitutional Court's independence is aimed at examining its legal nature and exposing to its organic and functional independence, in the light of the Constitutional Amendment of 2020, the Rules of Procedure of the Constitutional Court and Act No. 22-19 establishing the procedures and procedures for notification and referral before the Constitutional Court. Under the Constitutional Court system, the Constitutional Founder introduced new conditions for membership of the Constitutional Court that enshrine the independence and impartiality of its members in terms of its efficiency requirement And his eagerness to recognize immunity for members, with the exclusion of Parliament from representation in the configuration to remain in the framework of his original mission - legislation and censorship - is what we highly appreciate to keep the Court away from any partisan and political orientation. As to their functional autonomy, despite the obligation of all public and administrative and judicial authorities to implement promptly their decisions, their functional immunity is established, However, the exclusion of the latter from automatic movement makes it trapped in notification and referral.
