اختصاص المحكمة الدستورية لرفع الحصانة البرلمانية في ظل التعديل الدستوري لسنة 2020

Résumé: تتناول هذه الدراسة موضوع رفع الحصانة البرلمانية كاختصاص من بين الاختصاصات المستحدثة للمحكمة الدستورية في ظل التعديل الدستوري لسنة 2020، والتي تهدف إلى بيان الدوافع والخلفيات التي جعلت المؤسس الدستوري يمنح هذا الاختصاص للمحكمة الدستورية، للبث في حالات رفع الحصانة البرلمانية بناءا على إخطار من الجهات المختصة،وفق ضوابط وإجراءات حددها المشرع باعتبار أن الحصانة البرلمانية احد أهم ضمانات الاستقلالية لممارسة العمل البرلماني وحماية العضو البرلماني أثناء قيامه بمهامه البرلمانية، وبإسناد هذا الاختصاص للمحكمة الدستورية لا شك أنه سيمكن الجزائر من وضع قدم راسخة وثابتة في مجال العدالة الدستورية، وتكريس دولة القانون. This study examines the subject of lifting parliamentaryimmunity as one of the newlyestablishedcompetencies of the Constitutional Court under the constitutionalamendment of 2020. It aims to elucidate the motives and background thatled the constitutionallegislator to grantthiscompetence to the Constitutional Court, to adjudicate cases of lifting parliamentaryimmunitybased on notifications from relevant authorities, in accordance withcriteria and procedures set by the legislator, consideringparliamentaryimmunity as one of the most important guarantees for the independence of parliamentarywork and the protection of parliamentarymemberswhilecarrying out theirparliamentaryduties. By assigningthiscompetence to the Constitutional Court, undoubtedly, Algeriawillbe able to establish a solidfoundation in the field of constitutional justice, and consolidate the rule of law.
