التركيبة البشرية للمحكمة الدستورية في الجزائر: بين ضمانات الاستقلالية وتكريس قواعد العدالة الدستورية

Résumé: من خلال التعديل الدستوري لسنة 2020 استحدثت المحكمة الدستورية كمؤسسة رقابية منوط بها ضمان احترام أحكام الدستور والحفاظ على نصوصه، وعزز هذه الهيئة المستقلة بجملة من النصوص القانونية تنظم شروط العضوية فيها وكذا اختصاصاتها، وعليه جاءت هذه الورقة البحثية تهدف إلى دراسة الأحكام الناظمة للتركيبة البشرية للمحكمة الدستورية، والبحث عن مدى استقلاليتها عضويا بما يتحقق معها متطلبات العدالة الدستورية، ويضمن بذلك سمو الدستور ويحمي الحقوق والحريات. وعليه إذا كانت المحكمة الدستورية بعضويتها قد تعززت بمجموعة من الشروط والضمانات بما يكفل استقلاليتها وحيادها أمام السلطات العامة للدولة، إلا أنها في جانب آخر لاقت من أوجه المحدودية ما ينقلها من الاستقلالية المطلقة الى الاستقلالية النسبية في مجال تكريس العدالة الدستورية. Through the Constitutional Amendment of 2020, the Constitutional Court was created as a supervisory institution charged with ensuring respect for the provisions of the Constitution and preserving its provisions and to support this independent body with many legal texts regulating the conditions of its membership as well as its terms of reference; This paper therefore aims to study the provisions governing the human composition of the Constitutional Court. The Constitution guarantees the supremacy of the Constitution and protects rights and freedoms. Thus, while the Constitutional Court's membership has been strengthened by a range of conditions and guarantees, thus achieving its independence and impartiality before the public authorities of the State, it is in another limited aspect of its transfer from absolute to relative independence in the field of constitutional justice.
