Résumé: كان للثورة المعلوماتية مفهوم تقني دخل مجال القانون وأولد ما يسمى بالعقد الإلكتروني نتيجة للتطورات الكمية والنوعية الهائلة التي دخلت في عالم الحاسوب والإتصالات ومست جميع مستويات وجوانب الحياة ، بما فيها جانب إبرام المعاملات والعقود باستخدام وسائل التبادل الإلكتروني للبيانات ، وهو ما يميزه عن بقية العقود الأخيرة التقليدية فهو يبرم عن طريق الشبكة المعلوماتية . فمسألة معالجة العقود الإلكترونية يعد أمر مهم من الناحية القانونية فهو يساعد في فهم الإشكاليات القانونية التي يطرحها هذا العقد في مرحلة الإبرام والتنفيذ والإثبات ، لذا كان لابد أن ترتكز دراستنا على ذلك . الكلمات المفتاحية : العقد الإلكتروني، الحاسوب،التبادل الإلكتروني،العقود التقليدية. Abstract: The informationrevolution had a technical concept that entered the field of law and gave birth to the so-called electronic contract as a result of the huge quantitative and qualitative developments that entered the world of computers and communications and touched all levels and aspects of life, including the aspect of concluding transactions and contracts using the means of electronic data exchange, which distinguishes it from the rest of the other traditional contracts. It is concluded through the information network. The issueof addressing electronic contracts is an important matter from a legal point of view, as it helps in understanding the legal problems posed by this contract at the stage of conclusion, implementation and proof, so our study had to be based on that. key words: Electronic contract; information revolution; computer; electronic exchange; traditional contracts.
