الجانب المعقد لضابط الجنسية في مسائل الاختصاص القضائي الدولي

Résumé: تُمَكِن الجنسية الفرد من الاستفادة من حماية الدولة في سياق النزاعات الدولية، لذلك فإنه في مجال القانون الدولي الخاص يعتبر معيار الجنسية الضابط الذي يحدد الاختصاص القضائي الدولي بامتياز، ومع ذلك فإنه أثناء تطبيقه تبرز بعض التعقيدات التي تجعل منه ضابطا معقدا للغاية ولا يتطابق دائمًا مع الواقع. تقييم ضابط الجنسية كمعيار للاختصاص القضائي الدولي يبين أنه وبالرغم من الجوانب المعقدة التي يتميز بها والانتقادات الموجه إليه، إلا أنه يبقى معيارًا موثوقًا به للربط خاصة في مسائل الأحوال الشخصية، تدعيم ضابط الجنسية بضوابط أخرى كضابط الموطن سيمكن من تجاوز كل الصعوبات المتعلقة به. Citizenship enables the individual to benefit from the state protection in the context of international dispute, thus, the nationality criterion in the Private International Law is the factor which determines the International Jurisdiction with distinction, yet there are some complications while its application; what makes it a very complicated and not always consonant with reality. The assessment of nationality criterion as a factor of International Jurisdiction shows that although its complications and criticisms against it, it still be a reliable factor especially to link between personal status matters. One of the things that help to overcome such complications is to support the nationality factor by other factors like domicile factor.
