القضاء الجنائي الدولي بين الفاعلية القانونية والممارسة الواقعية

Résumé: خطى المجتمع الدولي خطوات جادة من أجل انشاء قضاء جنائي دولي يهدف الى تفعيل مبدأ العدالة الجنائية الدولية من المنظور الواقعي، بدءا من تأسيس دول التحالف المنتصرة في الحرب العالمية الثانية محكمتي نورمبورغ وطوكيو، مرورا بإنشاء مجلس الأمن لمنظمة الأمم المتحدة محاكم جنائية دولية خاصة والمتمثلة في المحكمة الجنائية الدولية ليوغوسلافيا سابقا في 1993، والمحكمة الجنائية الدولية لرواندا في 1994. أحدثت منظمة الأمم المتحدة بإنشائها للمحكمة الجنائية الدولية الدائمة تطويرا في القضاء الدولي الجنائي من الصبغة المؤقتة إلى الصبغة الدائمة، ولا شك أن إنشاء هذه المحكمة يشكل مرحلة هامة من مراحل تطور النظام القضائي الدولي الجنائي. The international community has taken serious steps towards the establishment of an international criminal court aimed at activating the principle of international criminal justice from a realistic perspective, starting with the founding of the victorious alliance countries in the Second World War, the Nuremberg and Tokyo tribunals. The establishment of the UN Security Council by special international criminal tribunals represented in The International Criminal Tribunal for the former Yugoslavia in 1993 and the International Criminal Tribunal for Rwanda in 1994. The foundation of the Permanent International Criminal Court has brought about an evolution in international criminal justice from temporary to permanent. The creation of such a court is an important stage in the development of the international criminal justice system.
