حرية التنقل طبقا للتعديل الدستوري 2016 Freedom Of Movement In Accordance With Constitutional Amendment 2016

Résumé: عرف التعديل الدستوري لسنة 2016 نوعا من التكريس والرقي بالحقوق والحريات تدعيما للدمقراطية ودولة القانون، وهذا ما يبرز اهتمام المؤسس الدستوري بها من خلال كفالتها وإقرار الضمانات اللازمة لحمايتها لاسيما الحق في ممارسة حرية التنقل الذي شمله التعديل بإضافات جديدة في المادة 55 منه، وهذا من شأنه أن يعزز مكانة هذا الحق الذي يعد أساسيا لممارسة بقية الحقوق الأخرى كحق العمل والتعليم ...إلخ، وتحقيقا لذلك سعى المشرع الجزلئري منذ زمن في مراجعة التشريعات ذات الصلة بغرض التمكين من ممارسة هذا الحق بكل حرية دون تقييد تمكينا لممارسة حقوق أخرى، إلاّ أنّه رغم ذلك يظل حق ممارسة حرية التنقل نسبيا غير مطلقا. وإنما تحده ضوابط وهذا حماية لحرية الفرد حتى لا تتعرض للانتهاك من الآخرين أو تتعارض مع حقوق الغير أو تشكل إخلالا بالنظام العام. The 2016 constitutional amendment defined a kind of dedication and promotion of rights and freedoms in support of democracy and the rule of law, which highlights the constitutional institution's interest in it through sponsorship and the adoption of the necessary guarantees to protect it, referring to the legislation to regulate it and to indicate the conditions of its exercise as not absolute. It is limited by controls and this protects the freedom of the individual so as not to be violated by others or to interfere with the rights of others or constitute a breach of public order, in order to achieve equality for all in the enjoyment of rights and freedoms and to balance the public interest with the private interest.
