المعارضة البرلمانية في الجزائر بين ضرورة التفعيل والمعوقات

Résumé: منح المؤسس الدستوري الجزائري في تعديل الدستور لسنة 2016 جملة من الحقوق للمعارضة البرلمانية بقصد تمكينها من المشاركة الفعلية والفعّالة في الحياة السياسية والنيابية. إنّ أهم الحقوق التي منحها المؤسس الدستوري للمعارضة البرلمانية؛ الحق في التعبير وإبداء الرأي، الحق في المشاركة الفعلية في التشريع؛ رقابة عمل الحكومة؛ التمثيل في أجهزة غرفتي البرلمان وإخطار المجلس الدستوري حول دستورية قانون ما. بالرغم من ذلك إلاّ أنّ هذه الحقوق تبقى ناقصة؛ ولاسيما في ظل غياب ضمانات حقيقية تمكّن المعارضة من ممارسة هذه الحقوق. The constitutional founder of Algerian constitution after the 2016 amendment has granted a number of rights to the parliamentary opposition to allow them to participate effectively in political and parliamentary life. The most important constitutional rights granted by the founder to the parliamentary opposition; the right of expression and opinion, the right of effective participation in legislation, control of the government, representation in both parts of the Parliament and inform the Constitutional Council about the constitutionality of a law. However, these rights remain insufficient especially in the absence of real guarantees that allow the opposition to exercise these rights.
