الإختصاص التأديبي بالنظر في المخالفات التأديبية في ظل الأمر رقم 06-03

Résumé: ملخص: يحظى الاختصاص التأديبي بأهمية بالغة في الاطار العام للوظيفة العمومية بناء على ذلك حرص المشرع الجزائري على ان يمارس هذا الاختصاص وفقا لاحكام مبدأ المشروعيه، فلا يعاقب الموظف العام الا على الافعال التي تندرج في خانة المخالفات التاديبية ومن قبل السلطة المختصة بذلك. تجلت لنا من خلال هذه الدراسة مجموعة من الاستنتاجات منها ان لاراء اللجنة الادارية المتساوية الاعضاء المنعقده كمجلس تاديبي طابع الزامي في العقوبات التاديبية من الدرجتين الثالثة والرابعة، حيث لا يمكن للسلطة التي لها صلاحيات التعيين تجاوز الراي الملزم لهذه اللجنة. وبناء على ما سبق قدمنا عددا من التوصيات من اهمها تعزيز ضمانة تدخل اللجنة الادارية المتساوية الاعضاء في كافة المخالفات والعقوبات التاديبية بما في ذلك الدرجتين الاولى والثانية بموجب الراي الاستشاري لها. Abstract: Disciplinary jurisdiction holds significant importance within the general framework of public service. Accordingly, the Algerian legislator has emphasized the exercise of this specialization in accordance with the principles of legality, Public employees are only penalized for actions falling within the realm of disciplinary violations and sanctioned by the competent authority. This study reveals several conclusions, including the authoritative nature of the Administrative Committee composed of equal members, acting as a disciplinary council for third and fourth-degree disciplinary sanctions, The appointing authority cannot override the binding opinion of this committee. Based on the findings, recommendations are presented, such as strengthening the guarantee of the intervention of the Administrative Committee in all violations and disciplinary sanctions, including the first and second degrees, based on its advisory opinion.
