دور العرف في الخطبة وآثاره بين الشريعة الإسلامية والقانون The Role Of Custom In The Sermon And Its Effects Between Islamic Law And Law

Résumé: إن الحياة الاجتماعية دائما في تطور تماشيا مع تغير الزمان والمكان، مما أثر هذا التطور على سلوكيات الأفراد فانعكس على عاداتهم وأعرافهم في الكثير من الميادين وخاصة في علاقتهم الأسرية وروابطهم الاجتماعية، فالعديد من الأعراف تختلف من منطقة لأخرى ومن بلد إلى آخر. ولما كان عقد الزواج من أخطر العقود التي يبرمها الشخص في حياته فقد نظمه الشارع الحكيم بأحكام تنظم مقدمته والمتمثلة في الخِطبة والتي لم يستحدثها الإسلام ولا القانون الوضعي، بل هي تقليد قديم ساد في المجتمعات البدائية، ونظرا لانتشار ظاهرة العدول عن الخطبة في مجتمعنا المعاصر سواء بسبب أو بدون سبب، مما نتج عنه أحيانا أضرار مست تلك العلاقة التي كانت تجمع الخاطبين وربما يصل النزاع إلى أروقة المحاكم والقضاء. Social life is always evolving in line with the change of time and place, which affected this development on the behavior of individuals and was reflected in their habits and customs in many fields, especially in their family relationship and social ties, as many customs differ from one region to another and from one country to another. And since the marriage contract is one of the most dangerous contracts that a person concludes in his life, the wise legislator organized it with provisions regulating its introduction, represented in the engagement, which was not introduced by Islam or the positive law. Or without a reason, which sometimes resulted in damages affecting the relationship that brought together the suitors, and the dispute may reach the corridors of the courts and the judiciary.
