مدى كفاية الضوابط القانونية لنزع وزرع الأعضاء والأنسجة والخلايا البشرية في التشريع الجزائري

Résumé: توصل التقدم الطبي الحديث إلى إمكانية علاج بعض الأمراض والتشوهات في أعضاء جسم الإنسان بإجراء عمليات جراحية تتضمن استبدال العضو التالف المريض بنقل وزرع الأعضاء والأنسجة والخلايا البشرية بعضو سليم حتى تستمر وظائفه الفيزيولوجيا في العمل بانتظام. وقد وفق المشرع الجزائري إلى حد بعيد في تأطير هذه العمليات بسن ضوابط قانونية عامة وأخرى خاصة بموجب قانون الصحة كحماية لحرمة التصرف في جسم الإنسان بإجراء جراحة نزع وزرع الأعضاء والأنسجة والخلايا البشرية في ظروف لائقة تقتضي حماية للسلامة الجسدية للطرفين، غير أن التطور المستمر في مجال الطب يقتضى ضوابط أكثر صرامة لحماية صحة الأفراد وترقيتها. Modern medical progress has reached the possibility of treating some diseases and deformities in the human body organs by performing surgical operations that include replacing the damaged diseased organ by transferring and transplanting human organs, tissues and cells to a healthy organ so that its physiological functions continue to function regularly. The Algerian legislator has succeeded to a large extent in framing these operations by enacting general and special legal controls under the Health Law as a protection for the sanctity of disposing of the human body by performing surgery to remove and transplant organs, tissues and cells in appropriate conditions that require protection of the physical safety of both parties, but the continuous development in the field of medicine requires stricter controls to protect and promote the health of individuals.
