أحكام نزع وزرع الأعضاء والأنسجة والخلايا البشري في قانون الصحة الجديد

Résumé: لقد أدى التطور العلمي في مجال الطب إلى علاج العديد من الأمراض وبالتالي إنقاذ حياة العديد من المرضى، وشهد هذا التطور دور كبير في مجال عمليات نزع وزرع الأعضاء البشرية الأنسجة والخلايا البشرية حيث عرفت هذه الأخيرة انتشارا واسعا في العصر الحديث نظرا لما حققته من فوائد للبشرية . إلا أنه لابد أن تمارس هذه العمليات وفق ضوابط معينة، لهذا عمل المشرع في قانون الصحة الجديد على استحداث أحكام قانونية تحقق نوع من التوازن بين حماية حق الإنسان في سلامته الجسدية المكفول قانونا وبين محاربة كل أشكال الإستغلال والإنتهاكات التي قد تتعرض لها الأعضاء البشرية. Abstract: Scientific development in the field of medicine has led to the treatment of many diseases and thus saved the lives of many patients. This development has seen a significant role in the field of human organ transplantation and transplantation of human tissues and cells. However, these processes must be practiced in accordance with certain controls.Therefore, the legislator has worked in the new health law to introduce legal provisions that strike a balance between protecting the human right to physical integrity guaranteed by law and combating all forms of exploitation and violations against human organs.
