تجريم الاستخدام غير المشروع لبطاقة الدفع الالكتروني من قبل أطرافها في القانون الجزائري

Résumé: تعتبر بطاقة الدفع الإلكتروني وسيلة وفاء مستحدثة ذات تقنية تكنولوجية عالية، تتميز بإقبال كبير من طرف المتعاملين بها في تسوية معاملاتهم المالية نظرا لسهولة التعامل بها، وكذا الحماية من مخاطر حمل النقود. ولكن قد تتعرض هذه البطاقة إلى اعتداءات واستخدامات غير مشروعة تفقدها ثقتها الائتمانية، وتهدد مستخدميها، وتصدر من الأشخاص أطراف التعامل بالبطاقة أو من الغير، كما قد تنجم الاعتداءات عن طبيعة هذه الوسيلة التي هي عبارة عن خدمة مالية تتم في بيئة مفتوحة كالأنترنت. سنحاول من خلال هذا البحث تحديد صور هذه الاعتداءات، الصادرة من قبل أطراف البطاقة وهم الحامل، المصدر لها والتاجر، ونعرض الجزاءات الجنائية المقررة لها في التشريع الجزائري. Abstract: The electronic payment card is consired a newly developed high-tech method of payment, characterized by a high demand by its customers in settling their financial transactions due to the ease of dealing with it, as well as protection from the risks of carrying cash. But this card may be exposed to illegal attacks and uses that lose its credit confidence, and threaten its users, and be issued by the personsin the card transaction or from third parties. The attacks may also result from the nature of this means, which is a financial service that takes place in an open environment such as the Internet. We will trough this research to identify these attacks, issued by the card parties who are the holder, the issuer and we present the criminal penalties prescribed for it in Algerian legislation.
