التدخل الدولي ومسؤولية الحماية في الأزمة الليبية Intervention And The Responibility To Protect In The Libyan Crisis International

Résumé: تسلط الدراسة الضوء على التدخل في ليبيا من طرف قوات الحلف الشمال الأطلسي(الناتو) من المنظور القانوني والإنساني، حيث أن هذا التدخل جاء تطبيقا للقرار الأممي رقم 1973، غير أنه من خلال تطبيق هذا القرار نشب جدل دولي بشأن مبدأ التدخل العسكري لحماية حقوق الإنسان في ليبيا، فهناك طرف رأى في هذا التدخل هو حماية للشعب الليبي من نظام القذافي (فرنسا، الولايات المتحدة الأمريكية وبريطانيا)، وطرف آخر رأى ضرورة الحفاظ على سيادة الدول المستقلة وعدم التدخل في شؤونها الداخلية (دول عالم الجنوب)، بحجة أن سيادة الدولة تعتبر أهم مبدأ في تنظيم الدولي والعلاقات الدولية المعاصرة، والتيار الأخير دع إلى ترشيد مبدأ التدخل الإنساني بحيث يتم الاعتراف به وقبوله، ولكن مع وضع ضوابط وتدابير كفيلة بضمان موضوع تطبيقه. Abstract : The study sheds light on the intervention in Libya by the North Atlantic Treaty Organization (NATO) from a legal and humanitarian perspective, as this intervention came in implementation of United Nations Resolution No. 1973, but through the application of this resolution an international controversy erupted regarding the principle of military intervention to protect human rights in Libya, there is a party that saw this intervention as protecting the Libyan people from the Gaddafi regime (France, the United States of America and Britain), and another party saw the need to preserve the sovereignty of independent countries and not to interfere in their internal affairs (the countries of the world of the south), arguing that the sovereignty of the state is considered the most important A principle in the organization of international and contemporary international relations, and the latter trend called for the rationalization of the principle of humanitarian intervention so that it is recognized and accepted, but with the establishment of controls and measures to ensure the subject of its application.
