سلطة مجلس المنافسة في ضبط السوق

Résumé: نصت المادة 37 من دستور 1996 على مبدأ حرية الصناعة والتجارة، هذا المبدأ أكد عليه التعديل الدستوري لسنة 2016 في المادة 43 منه، والذي انبثق عنه مبدأ حرية المنافسة، نتيجة لانتقال الدولة من النظام الاقتصادي المشترك إلى نظام الاقتصاد الحر، حيث توجب حماية هذا المبدأ بوضعه في إطار قانوني وتنظيمي، من أجل تحقيق شروط المنافسة الحرة والنزيهة وحماية الاقتصاد الوطني، حيث تجسد ذلك في إنشاء مجلس المنافسة، هذا الأخير يعنى بالمحافظة والسهر على تحقيق مبدأ المنافسة الحرة وحماية النظام الاقتصادي للدولة، عن طريق التطبيق الصارم لمبادئ وأحكام قانون المنافسة، حيث يمارس مجلس المنافسة مجموعة من الصلاحيات الاستشارية والتنازعية من أجل وضع حد للممارسات المقيدة للمنافسة وضبط المنافسة في السوق، لكن هذه الصلاحيات الواسعة، واجهت بعض العوائق والتي تحد من فاعليته في أداء مهامه، خاصة فيما يتعلق باستقلاليته وتداخل اختصاصه مع اختصاص أجهزة الضبط القطاعية الأخرى. The State, through the strict application of the principles and provisions of the Competition Law, where the Competition Council exercises a range of advisory and conflicting powers in order to put an end to the restrictive practices of competition and control competition in the market, but these broad powers have encountered some obstacles that limit its effectiveness in the performance of its functions, particularly with regard to its independence and interference with the competence of other sector control bodies.
