آليات الحماية الدولية والوطنية للممتلكات الثقافية في القدس

Résumé: تتحدث هذه الدراسة القانونية عن الآليات المختلفة لحماية الممتلكات الثقافية في القدس وتبحث في فعاليتها من خلال قواعد القانون الدولي الإنساني، وذلك بإبراز دور الوسائل الدولية في هذا الصدد من تشجيع للتعاون الدولي والاتفاقيات الثنائية والتصدي للاتجار غير المشروع ومكافحته ثم تبين دور المنظمات الدولية الفاعلة كالأمم المتحدة عموما واليونسكو على وجه الخصوص باعتباره مختصا في مجال الثقافة والعلوم والصليب الأحمر الدولي وما يتضمنه فهو يمثل أحد ضمانات إنفاذ القانون الدولي الإنساني ثم نتطرق لدور الوسائل الإقليمية والمتمثلة في المنظمتين العربية والإسلامية للتربية والثقافة والعلوم وأخيرا الوسائل الوطنية المتمثلة في مؤسستي الأقصى للوقف والتراث والقدس الدولية لأجل معرفة مدى مواءمة التشريعات الوطنية الفلسطينية للصكوك والمواثيق الدولية من جهة، وفعاليتها في حماية الممتلكات الثقافية بالقدس من جهة أخرى. ABSTRACT: This legal study discusses the different mechanisms for the protection of cultural property in Jerusalem and Its effectiveness through the rules of international humanitarian law, by highlighting the role of international means in this regard from the promotion of international cooperation ,bilateral agreements and banning the illicit trade. The study also shows the role of the effective international organizations like the U.N and UNESCO, in particular, as a specialist in the field of culture, science and the I.C.R.C which represents one of the international humanitarian law enforcement guarantees, then, l address the role of the regional The role of the Arab and Islamic Educational, Cultural and Scientific Organizations. finally, I focus on the national means represented by the two institutions: Aqsa for wakaf and heritage , also the Jerusalem International ; in order to make the suitability between the Palestinian national legislations and the international conventions and instruments on one hand, and their effectiveness in the protection of cultural property in Jerusalem on the other hand.
