المحافظة على البيئة و حمايتها في ضوء أحكام المرسوم التنفيذي 55/22

Résumé: رخصة البناء آلية فعالة وضمانة أساسية لإحترام قواعد التهيئة و التعمير من جهة و كذا حماية البيئة و الوسط الذي يعيش فيه الإنسان من جهة أخرى، فهي تمنع إنتشار البناءات الفوضوية و تعمل على إحترام القواعد العامة للنعمير و معايير البناء و الأمن، وبالتالي الحفاظ على سلامة الأشخاص و ممتلكاتهم و إستغلال العقار بشكل عقلاني يمنع تدهور الوضع البيئي، فهي تعد آلية من الآليات القانونية التي وضعها المشرع لبسط رقابته القبلية على كل أعمال البناء و التعمير و بالتالي الحفاظ على النسيج العمراني و المظهر الجمالي له، لكن قد يحدث و أن لا يتم إحترام رخصة البناء المسلمة و هو ما يحول دون تسليم رخصة المطابقة، وهو الأمر الذي أدى إلى ضرورة تدخل المشرع من أجل إيجاد حل يرضي أصحاب الرخص من جهة و يوفر الحماية اللازمة من جهة أخرى، و قد تجسد ذلك بإصدار المرسوم التنفيذي رقم 22/55 و المتعلق بشروط تسوية البنايات غير المطابقة لرخصة البناء المسلمة. Building permits are an effective mechanism and a fundamental guarantee for respecting urban planning and the living environment of humans on the other, they prevent the spread of unauthorized constructions and ensure compliance with general urban development rules, construction standards, and safety measures. Consequently, they preserve the safety of individuals and their properties, and ensure the rational use of real estate to prevent environmental degradation, they are considered a legal mechanism established by the legislator to exert tribal control over all construction and development activities, thereby preserving the urban fabric and its aesthetic appearance. However, there may be cases where the issued building permit is not respected, which prevents the issuance of a compliance permit. This has led to the legislator’s intervention to find a solution that satisfies permit holders on one hand, and provides necessary environmental protection on the other hand, this was achieved through the issuance of executive decree n°22-55 concerning the conditions for regularizing non-compliant buildings with the issued building permit.
