الحماية المدنية للمستهلك من الشروط التعسفية في العقد الالكتروني

Résumé: تعد فكرة الشرط التعسفي آلية لإعادة توازن العقد، ووسيلة لحماية المستهلك، تناولها المشرع ضمن القواعد العامة وفي القانون 04-02 . ونتيجة للتطور التكنولوجي الذي أفرز عنه وجود عقود نموذجية ينفرد في صياغتها المهني بطريقة تخدم مصالحه انتشرت الشروط التعسفية ،خاصة في ظل تطور وسائل الإتصال الحديثة التي تدفع المستهلك إلى التعاقد دون دراسة لبنود العقد. ولم يخص المشرع الجزائري العقد الإلكتروني تنظيما خاصا لذلك فإن الحماية المدنية للمستهلك من الشروط التعسفية لا تخرج عن الوسائل التي أتاحها المشرع لحماية الطرف الضعيف ومكافحة الشروط التعسفية، التي تتمثل في تدخل القاضي لإعادة التوازن العقدي. Abstract The idea of arbitrary condition is considered as a mechanism to re-balance the contract, also as a means of consumer protection, it was addressed by the legislator within the general rules in Law 04-02. As a result of the technological development that resulted to the existence of model contracts, unilateral in its formulation a professional in a way that serves its interests, the arbitrary conditions spread, especially in the light of the development of modern means of communication that push the consumer to contract without studying the terms of the contract. The Algerian legislator did not pay special attention to the e-contract, so the consumer protection from arbitrary conditions does not deviate from the means provided by the legislator to protect the weak party and to combat arbitrary conditions, which is the judge's intervention to restore the balance of contractions
