صندوق النفقة كآلية قانونية لتحصيل نفقة الطفل المحضون - دراسة على ضوء القانون 15/01 -

Résumé: تعد النفقة حق من حقوق الطفل المالية التي أقرتها مختلف اتفاقيات حقوق الإنسان بما فيها اتفاقية حقوق الطفل في المادة 27 منها، كما أنّ قانون الأسرة الجزائري أوجب في المادتين 75 و 76 منه، بأن نفقة الطفل على أبيه، و في حالة عجزه تلزم الأم بذلك و لكن فقط في حالة يسرها، غير أنه في كثير من الأحيان قد يحرم الطفل من النفقة خاصة عند وقوع الطلاق بين الوالدين، و ذلك إما بسبب فقر الأب أو تهربه من دفع النفقة. لذلك بغرض حماية الطفل و لأجل تحصيل و تأمين نفقته أنشأ المشرع الجزائري بموجب القانون رقم 15/01 المؤرخ في 04/01/2015 "صندوق النفقة " كآلية جديدة يستفيد بموجبها الطفل المحضون بالنفقة المحكوم له بها. ABSTRACT: Alimony is considered as one of the children’s financial rights, approved by various agreements, such as the Convention on the Rights of the Child in Article 27, and also approved by the Algerian Family Law in Articles 75 and 76, that the child’s maintenance is borne by the father, and in the event of his inability the mother is obligated to do so in the event of a divorce between the parents,The child may be deprived of it because of the father’s poverty or his evasion of paying it. For the purpose of protecting the child, the Algerian legislator established, by Law No 15/01, the “Alimony Fund” as a new mechanism under which the child in custody benefits from the alimony awarded to him.
