أهمية العقار في التنمية المحلية - قراءة تحليلية للواقع الجزائري في إطار قانون التوجيه العقاري –

Résumé: ملخص: الهدف من هذه الورقة البحثية هو تبيين أهمية العقار ونمط تسييره على المستوى المحلي في إطار الدور التنموي للجماعات المحلية، وذلك في إطار المقاربة التي جاء بها قانون التوجيه العقاري(90-25) في الجزائر، حيث يعتبر هذا القانون كتكييف للتشريع العقاري مع أحكام دستور 23فبراير1989،ومن ثمة إبراز الدور التنموي للجماعات المحلية في إطار قانوني البلدية والولاية الساريي المفعول. خلصت الدراسة إلى اعتبار أن التنمية المحلية ماهي إلا المحصلة النهائية للسياسة الاقتصادية ككل، أما في جانبها التطبيقي فإن غياب سياسة عقارية واضحة المعالم من شأنه أن يصعب من المهام التنموية للجماعات المحلية Abstract: The objective of this research document is to show the importance of land and its mode of management at the local level within the framework of the structuring role of local authorities, within the framework of the approach carried by the land orientation law. (90-25) in Algeria, where this law is considered as an adaptation of land legislation with the provisions of the Constitution of February 23, 1989, thus emphasizing the developmental role of local authorities within the framework of the law of the commune and the willaya in force. The study concluded that local development is only the end result of economic policy as a whole. As for its implementation, the absence of a clear land policy makes the development tasks of local communities difficult.
