مفهوم السرقة العلمية وصورها في القانون الجزائري- دراسة تحليلية للقرار الوزاري رقم 1082 لسنة 2020-

Résumé: مـلخـص: يتناول هذا المقال دراسة السرقة العلمية في القانون الجزائري باعتبارها من أخطر مظاهر الإخلال بأخلاقيات البحث العلمي، وذلك من خلال بيان مفهومها وتحديد صورها في ضوء القرار الوزاري رقم 1082 لسنة 2020، حيث تم تحليل ومناقشة ما جاء في هذا القرار، للوصول إلى معرفة مدى دقته وضبطه لمفهوم السرقة العلمية، واستيعابه لصورها وأشكالها، من أجل منع أيّ لبس في هذا الموضوع قد يؤدي إلى تضارب في التفسيرات، أو الإفلات من المسؤوليات، وبالتالي تحقيق أكبر حماية قانونية لحقوق الملكية الفكرية. وقد خلصت الدراسة إلى أن هذا القرار، ورغم ما فيه من إيجابيات تتعلق بتوسعه في تعريف السرقة العلمية، وتفصيله في ذكر صورها؛ إلا أن فيه بعض النقائص التي تحتاج إلى استدراك، كعدم دقة التعريف في بعض جوانبه، وإغفاله لبعض الصور المهمة للسرقة. Abstract: This article deals with the study of scientific theft in Algerian law as one of the most dangerous manifestations of breaching the ethics of scientific research, by clarifying its concept and defining its forms in light of Ministerial Resolution No. 1082 of 2020. And his control of the concept of scientific theft, and his understanding of its forms, in order to prevent any confusion in this topic that may lead to conflicting interpretations, or escaping from responsibilities, and thus achieving the greatest legal protection for intellectual property rights, and the study concluded that this decision, despite the fact that it contains Positives related to his expansion of the definition of scientific theft, and its detail in mentioning its forms; However, it has some shortcomings that need to be remedied, such as the inaccuracy of the definition in some aspects, and its omission of some important forms of scientific theft.
