آلية الدفع بعدم دستورية القوانين على ضوء آخر المستجدات -دراسة مقارنة- الجزائر والمغرب The Exception Of Unconstitutionality Of Laws Mechanism In The Light Of The Latest Developments - A Comparative Study - Algeria And Morocco

Résumé: تعتبر آلية الدفع بعدم الدستورية وسيلة أساسية لتحريك الدعوى الدستورية ومن أهم الآليات الدفاعية المقررة لحماية حقوق الأفراد وحرياتهم، لذلك نظمت مختلف دساتير الدول المغاربية من بينها الجزائر والمغرب أحكامها وكيفيات تطبيقها وطرق لجوء أحد أطراف الدعوى إلى الهيئات الدستورية في تعديلاتها الحديثة، وبالتالي نهدف من خلال هذه الدراسة إلى تسليط الضوء على مفهوم آلية الدفع والإجراءات المتبعة بخصوصها في كل من الجزائر والمغرب، حيث نستنتج تطابقها إلى حد بعيد خاصة وأن الهدف واحد مع اختلافات طفيفة في الصياغة والمصطلحات المستعملة وفي تسمية المؤسسات الدستورية. The exception of unconstitutionality mechanism is considered a basic means to trigger the constitutional case and one of the moste important defensive mechanisms established to protect the rights and freedoms of individuals. Therefore, various constitutions of the Maghreb countries , including Algeria and Morocco , organized their provisions and the modalities of their application and the ways in which one of the parties to the case resorted to the constitutional bodies in their recent amendments. Therefore we aim , through this study , to shed light on the concept of the exception mechanism and the procedures followed in Algeria and Morocco where we conclude that they are largely identical, especially since the goal is the same with slight differences in the wording and terminology used and in naming constitutional institutions.
