آلية تحريك الرقابة على دستورية القوانين عن طريق الدفع بعدم الدستورية في إطار التعديل الدستوري لسنة 2020

Résumé: ملخص: إن الدفع بعدم دستورية القوانين هو نوع من أنواع الرقابة القضائية، وبذلك فإن هذا المقال يعالج مسألة الدفع بعدم دستورية القوانين، ويهدف الى توضيح الأحكام المنظمة للدفع بعدم الدستورية وحدود إعمالها، حيث تم النص على هذه الآلية بموجب المادة 195 من التعديل الدستوري الجزائري لسنة 2020. وقد مكنت آلية الدفع بعدم الدستورية المتقاضي من الدفاع عن حقوقه وحرياته المكفولة بنص الدستور، إذ أصبح من حق المتقاضين إثارة الدفع بعدم الدستورية بمناسبة دعوى قضائية ينظر فيها، وقد وضح القانون العضوي 18-16 شروط وكيفيات تطبيقها. كلمات مفتاحية: الرقابة الدستورية،المحكمة الدستورية، المتقاضي،الدفع بعدم الدستورية;الحقوق والحريات. Abstract: The defense of the unconstitutionality of laws is a type of judicial oversight, and thus this article addresses the issue of the defense of the unconstitutionality of laws. This study aims to clarify the provisions regulating the defense of unconstitutionality and the limits of its implementation, as this mechanism was stipulated under Article 195 of the Algerian constitutional amendment in 2020. The mechanism for defending unconstitutionality enabled the litigant to defend his rights and freedoms guaranteed by the constitution, as litigants had the right to raise the defense of unconstitutionality on the occasion of a court case being considered, and Organic Law 18-16 clarified the conditions and modalities of its application.
