منازعات استغلال العقار الصناعي في التشريع الجزائري
Résumé: يشكل العقار الصناعي الرهان الحقيقي لتجسيد السياسة الاستثمارية في الجزائر، ودعم مخططات التنمية الاقتصادية، لذلك سخرالمشرع الجزائري ترسانة قانونية كبيرة، عمل من خلالها على تكريس الاستغلال الأمثل للثروة العقارية باعتبارها حافز كبير للاستثمار، وتوجيهها لاحتضان المشاريع الاستثمارية ذات الطابع الصناعي والإنتاجي، بإقامة مناطق صناعية ومناطق للنشاطات، ونظم كيفية استغلالها، بداية باعتماد نظام التنازل والامتياز، إلا أن البيئة الاستثمارية في هذا المجال شهدت حالة عدم الاستقرار، وكثرة النزاعات بسبب التداخل الكبير في النصوص القانونية المنظمة للعقار الصناعي، والتسيير اللاعقلاني لحافظته العقارية، الذي أدى هو الآخر لاستنزافها دون تحقيق الهدف الذي وجدت من أجله. ليحاول المشرع الجزائري من جديد سد جميع الفراغات التي شهدتها النصوص القانونية السابقة، فقصر منح استغلال العقار الصناعي على صيغة وحيدة وهي الامتياز بالتراضي، مع الإبقاء على العقار الصناعي مملوك للدولة والمحافظة عليه من المضاربة والتحويل.
