حماية الاستثمار الأجنبي في التشريع الجزائري

Résumé: تهدف هذه الدراسة إلى بيان الحماية التي اقرها المشرّع الجزائري لحماية المستثمر الأجنبي وما مدى كفايتها لأنه على دراية كاملة بأهمية استقطاب الاستثمار الأجنبي لذا فقد سعى من خلال مختلف قوانين الاستثمار إلى اقرار جملة من الحوافز الضريبية والإدارية والحوافز التمويلية التي جاء بها القانون وقدم ضمانات عديدة للمستثمرين الأجانب مع ما يتماشى مع الاتفاقيات والمعاهدات الدولية كضمان استقرار أحكام القانون، كما يضمن عدم نزع ملكية المستثمر أو الاستيلاء عليها إلا في الحالات الخاصة ويترتب على ذلك تعويض عادل ومنصف، وضمان حق اللجوء إلى التحكيم والوساطة الدوليين أو إلى التحكيم الخاص لحل المنازعات التي قد تنشأ، كما تمنح للمستثمر حرية تحويل رؤوس الأموال والعائدات وذلك لتهيئة بيئة استثمارية ملائمة، لدعم الاستثمارات الوطنية وجذب الاستثمارات الأجنبية. Abstract: This study aims to demonstrate the protection approved by the Algerian legislature for the protection of the foreign investor and the extent of its adequacy because it is fully aware of the importance of attracting foreign investment. It has therefore sought through various investment laws to approve a number of tax and administrative incentives and financing incentives provided by the law and has provided numerous guarantees to foreign investors in line with international conventions and treaties such as ensuring the stability of the provisions of the law. and guarantees that the investor's ownership is not expropriated or taken over except in special cases, resulting in fair and equitable compensation; Guarantee of the right to resort to international arbitration and mediation or to special arbitration for the resolution of disputes that may arise and give the investor the freedom to transfer capital and returns to create an appropriate investment environment, to support national investments and attract foreign investments.
