Résumé: The legislator created the Monetary and Banking Council pursuant to Monetary and Banking Law No. 23-09, as a successor to the Monetary and Loan Council, specifying its composition and powers. Given the purpose of this law, it is supposed to grant the Monetary and Banking Council a distinct legal status that enables it to perform the role expected of it. However, examining the texts of Law No. 23-09 suggests that the legislator has maintained the same rules previously regulating the Monetary and Credit Council with some slight differences in terms of the membership aspect or in terms of the recognized powers of the Monetary and Banking Council, which are required to keep pace with developments taking place in the banking field. استحدث المشرع المجلس النقدي والمصرفي بموجب القانون النقدي والمصرفي رقم 23-09، خلفا لمجلس النقد والقرض، محددا تشكيلته وصلاحياته. وبالنظر إلى الغاية من هذا القانون ، فإنّه يفترض أن يمنح المجلس النقدي والمصرفي مركزا قانونيا متميزا يمكنه من آداء الدور المنتظر منه. إلا أنّ تقصي نصوص القانون رقم 23-09 يوحي بأنّ المشرع قد أبقى على نفس القواعد المنظمة سابقا لمجلس النقد والقرض مع بعض الاختلاف الطفيفة من حيث الجانب العضوي أو من حيث الصلاحيات المعترف بها للمجلس النقدي والمصرفي، والتي تستدعيها مواكبة التطورات الحاصلة في المجال البنكي.
