مرافقة المجلس النقدي و المصرفي للتحولات التي يشهدها القطاع المصرفي في الجزائر

Résumé: الملخص: تهدف هذه الدراسة الى تبيين أهم الإصلاحات التي مست المجلس النقدي و المصرفي، حيث أنشأ المشرع المجلس النقدي والمصرفي بموجب القانون النقدي والمصرفي رقم 23-09، و حدد تشكيلته وصلاحياته. وبالنظر إلى الهدف من هذا القانون، يُفترض أن يمنح المجلس مركزًا متميزًا يمكّنه من أداء الدور المنوط به. ومع ذلك، فإن مراجعة نصوص القانون رقم 23-09 تشير إلى أنه جاء بعدة تعديلات فيما يخص المجلس النقدي والمصرفي، وهذا من خلال تغيير اسمه من مجلس النقد والقرض إلى مجلس النقدي والمصرفي، وكذا من خلال التوسيع في تشكيلته، وأيضا في تعزيز صلاحياته، وهذا كله من أجل عصرنة القطاع و لمواكبة التطورات الحاصلة في القطاع البنكي. الكلمات المفتاحية: القانون النقدي والمصرفي، المجلس النقدي والمصرفي، محافظ بنك الجزائر، القطاع المصرفي المعاصر. Abstract: This study aims to clarify the legal status of the Monetary and Banking Council, as the legislator created the Monetary and Banking Council pursuant to Monetary and Banking Law No. 09-23, and defined its composition and powers. Given the objective of this law, it is assumed that the Council will be granted a distinguished legal status that enables it to perform the role assigned to it. A review of the texts of Law No. 09-23 indicates that the legislator maintained the same rules that previously regulated the Monetary and Credit Council, with some minor modifications in the organic aspects and the powers recognized for the Monetary and Banking Council, in order to keep pace with developments in the banking sector.
